Terms of Service

1. Introduction

Welcome to Aquafire, a product of inblock.io. These Terms of Service ("Terms") govern your access to and use of the Aquafire platform, including any associated APIs, tools, and documentation (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Definitions

  • "Aqua Protocol" refers to the cryptographic data integrity protocol on which Aquafire is built.
  • "User," "you," "your" refers to any individual or entity that accesses or uses the Service.
  • "Wallet" refers to a blockchain-compatible cryptographic wallet used for authentication and signing.
  • "Tree" refers to an Aqua Protocol data structure representing a document or object and its revision history.
  • "Content" refers to any files, documents, data, or other materials uploaded, signed, or created through the Service.

3. Account Terms

  • You must authenticate using a compatible Ethereum wallet (e.g., MetaMask) via the Sign-In with Ethereum (SIWE) protocol.
  • You are responsible for maintaining the security of your wallet and private keys. Aquafire does not store or have access to your private keys.
  • You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service.
  • You are responsible for all activity that occurs under your wallet address on the Service.
  • Subscription plans may impose limits on storage, file count, and other resources. Exceeding these limits may require a plan upgrade.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, store, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Violate any applicable local, state, national, or international law or regulation.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks connected to the Service.
  • Use the Service to forge or manipulate cryptographic signatures, timestamps, or verification data.

5. Intellectual Property

You retain all rights to Content you upload to the Service. By using the Service, you grant Aquafire a limited, non-exclusive license to process, store, and transmit your Content solely for the purpose of providing the Service.

The Service itself, including its design, code, documentation, and the Aqua Protocol implementation, is the intellectual property of inblock.io and its contributors. Open-source components are governed by their respective licenses.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

7. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may stop using the Service at any time. Because the Aqua Protocol is portable, you may export your data trees before discontinuing use.

If you have an active paid subscription, termination by us without cause will result in a pro-rata refund of any prepaid fees.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQUAFIRE AND INBLOCK.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

In no event shall our aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim.

9. General

  • Governing Law. These Terms shall be governed by the laws of Germany, without regard to its conflict of law provisions.
  • Modifications. We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service or email. Continued use after changes constitutes acceptance.
  • Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aquafire regarding the Service.
